Terms of Service

1. Acceptance of Terms

By creating an account, accessing, or using any part of MyNZ (the "Service"), you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree, you must not use the Service. By continuing to use the Service after sign up or access, you consent to all provisions herein.

2. Eligibility and Account

• You must be at least 13 years old, or the age of digital consent in your region.
• You are responsible for maintaining the confidentiality of your account and for all activities under it.

3. Content & License

You retain ownership of content you submit. By posting, you grant MyNZ a non-exclusive, worldwide, royalty-free, transferable license to host, store, reproduce, distribute, and display your content in connection with operating and improving the Service. All content posted by users on the Service is owned by MyNZand all copyrights thereto are hereby assigned to MyNZ upon posting.

We reserve the right to transfer ownership or management rights of any content posted by users to third parties at any time, and we shall not be held liable for any such transfer.

4. Prohibited Conduct

• Illegal, fraudulent, or deceptive activities
• Infringing or harmful content
• Scraping, spamming, or interfering with normal operation

5. Listings and Transactions

Marketplace, Services, Jobs, Property, and Motors listings must be accurate and lawful. Transactions occur directly between buyers and sellers. MyNZ is not a party to transactions and does not assume responsibility for item quality, delivery, payment issues, or disputes.

5.1. Premium Listings and Payments

ALL PAYMENTS FOR PREMIUM LISTINGS AND FEATURED PLACEMENT SERVICES ARE FINAL AND NON-REFUNDABLE UNDER ANY CIRCUMSTANCES, WITHOUT EXCEPTION. No refunds will be provided for any reason, including but not limited to: server downtime, service interruptions, technical issues, business closures, account suspension, violation of terms, changes to service features, dissatisfaction with results, or any other circumstances whatsoever. By purchasing any premium service, you acknowledge and agree that you will not be entitled to any refunds, credits, or compensation under any circumstances, regardless of whether the service was used or not.

6. Service Availability and Risks

The Service may be modified, suspended, or discontinued at any time. You understand that data networks and software may fail.

7. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT WARRANT UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE OPERATION, OR THAT DEFECTS WILL BE CORRECTED.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, MYNZ, ITS DIRECTORS, EMPLOYEES, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR BUSINESS INTERRUPTION, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE. We are not responsible for any issues arising from site downtime, outages, hacking, security incidents, or bugs,including but not limited to loss, corruption, or exposure of data, missed opportunities, or any other damages.

9. Indemnification

You agree to defend, indemnify, and hold harmless MyNZ from any claim, demand, or damages, including reasonable attorneys’ fees, arising out of your content, your use of the Service, or your violation of these Terms.

11. Changes to Terms

We may update these Terms at any time. If we make material changes, we will provide notice by posting the updated Terms or via other reasonable means. Continued use after the effective date constitutes acceptance.
